These Terms of Service ("Terms") govern your use of checkbaq.com and related pages, forms, and communications (the "Site") operated by CheckBaq LLC ("CheckBaQ," "we," "us," or "our"), 2000 Auburn Dr, Beachwood, OH 44122. By using the Site, you agree to these Terms.
Our Services
CheckBaQ helps former property owners and their heirs look into, and where appropriate pursue, claims for surplus funds (also called excess proceeds) that may remain after a foreclosure or tax sale. Information on the Site is general in nature. Submitting a form or booking a call does not create a client relationship. Any recovery services are provided only under a separate written agreement signed by you and CheckBaQ.
No Legal or Financial Advice
CheckBaQ is not a law firm and does not provide legal, tax, or financial advice. Nothing on the Site is legal advice. You may choose to consult an attorney, and in many cases you may be able to file a claim yourself directly with the court or agency holding the funds.
No Guarantee of Results
Eligibility, amounts, and timing depend on the facts of each case, applicable law, and decisions by courts or government agencies. We do not guarantee that funds exist, that a claim will be approved, or how long the process will take.
Fees
There are no upfront fees for an eligibility review. If you choose to work with us, our fee and all other terms will be stated in a written agreement before any work begins. If nothing is recovered under that agreement, you owe nothing.
Your Information
You agree to provide accurate information. Our collection and use of personal information is described in our Privacy Policy at checkbaq.com/privacy-policy.
Text Messages and Calls
If you opt in, you agree to receive calls and text messages from CheckBaQ at the number you provide about your inquiry, appointments, and case updates, and, if you separately consent, marketing messages. Consent is not a condition of any purchase or service. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help. Carriers are not liable for delayed or undelivered messages.
Acceptable Use
You agree not to misuse the Site, submit false information, or attempt to interfere with its operation.
Limitation of Liability
To the fullest extent permitted by law, CheckBaQ is not liable for any indirect, incidental, or consequential damages arising from your use of the Site. The Site is provided "as is."
Changes
We may update these Terms from time to time. The effective date above shows when they were last changed.
Governing Law
These Terms are governed by the laws of the State of Ohio.
